1Who this agreement is with

Famzo Learn is operated by [FULL LEGAL NAME], a sole proprietorship registered in India, trading as “Famzo Learn”, with its principal place of business at [REGISTERED ADDRESS] [GSTIN, if registered].

In these terms, “we”, “us” and “our” mean that business. “You” means the adult who sets up and holds the account. “Your child” means the child you set the app up for.

2What these terms cover

One agreement, three places you can meet us:

SurfaceWhat it is
The mobile apps Famzo Learn for iPhone and iPad from the Apple App Store, and for Android from Google Play.
The web app The version of Famzo Learn that runs in a browser at famzolearn.com/app, signed in to the same account as the mobile app.
The website The rest of famzolearn.com — these pages, the pricing page and anything you buy there.

Everything below applies to all three unless a section says otherwise. Where the rules genuinely differ — payments, mostly — the difference is called out in that section rather than hidden in a separate document.

3Accepting these terms

You accept these terms by creating an account, by starting a free trial, by subscribing, or by using the app or the web app. If you do not accept them, do not use Famzo Learn; if you have already paid and have changed your mind, section 7 explains how to get your money back.

By accepting, you confirm that you are at least 18 years old and that you are the parent or legal guardian of the child who will use the app, or that you have that parent’s permission to act for them.

4What Famzo Learn is

Famzo Learn gives a child aged 2–8 a short daily session: one general-knowledge card, one word or phrase in one of thirteen languages, and one chapter of a story. It also includes riddles, a Smart & Safe module written for a parent and child to work through together, a streak, and an optional Friends circle.

The day’s content is deliberately finite. When it is done, it is done — there is no next episode and nothing refills. That is a design decision, not a fault.

We add content over time. The library described on this website is what exists today; we may add to it, correct it, or retire an item that turns out to be wrong. We do not promise that any particular story, language or card will remain available forever, and we do not reduce the price if one is retired.

5Who may use it

The parent

The account belongs to you, the adult. You are responsible for everything done under it, including purchases, and for supervising your child’s use of the app in the way you think appropriate for their age.

The child

Your child uses the app under your account and your supervision. A child cannot create an account, cannot make a purchase, and is never asked for a real name — set-up asks for a nickname on purpose.

Age

The content is written for 2–8 year olds. Older or younger children may of course use it; the age bands only change how much text a card shows.

7Subscriptions, payment and refunds

7.1 The free trial

Famzo Learn is free to download and the trial gives you the whole library, not a locked sample. The length of the trial is shown in the app, and on the payments and subscriptions page, before you start it — whatever is shown there when you begin is what applies to you. We do not ask for a card to start it. When it ends, nothing is charged automatically — the app asks, and if you do nothing the app simply stops showing new daily content. One trial per person; we may decline a second trial on a new account for the same household.

7.2 The plans

Current prices, in your own currency, are on the payments and subscriptions page. There are two:

PlanHow it renews
MonthlyRenews every month until cancelled.
AnnualRenews every 12 months until cancelled.

Every plan includes the whole library and everything we add to it during the subscription. There is nothing else to buy inside the app — no coins, no gems, no unlocks — and there is no advertising on any plan, including during the trial.

7.3 Where you bought it decides the rules

This is the part people get caught by, so it is set out plainly.

BoughtWho takes the moneyWho handles cancellation and refunds
Inside the iPhone/iPad appApple Apple, under the Apple Media Services Terms. Manage or cancel in Settings → your name → Subscriptions. Refunds are requested at reportaproblem.apple.com.
Inside the Android appGoogle Google, under the Google Play Terms of Service. Manage or cancel at play.google.com/store/account/subscriptions.
On famzolearn.comOur payment processor, on our behalf Us, under 7.5 and 7.6 below.

Where Apple or Google took the payment, their terms govern that purchase and we cannot refund it, cancel it or change its price ourselves — we do not have access to it. We never see or store your card details in any of the three cases.

7.4 Auto-renewal

Monthly and annual subscriptions renew automatically at the end of each period, at the price then in effect, unless you cancel at least 24 hours before the period ends. Cancelling stops the next payment; it does not end the current period, and your child keeps full access until that period runs out. We do not pro-rate a period you have already paid for.

If we change the price of a plan you are already on, we will tell you by email at least 30 days before it takes effect, and you can cancel before then. Store subscriptions also require Apple’s or Google’s own consent step before a higher price can be charged.

7.5 Cancelling a subscription bought on famzolearn.com

Cancel any time from Parent Corner → Subscription in the app or the web app, or by emailing support@famzolearn.com from the address on the account. Cancellation takes effect at the end of the period you have paid for.

7.6 Refunds on famzolearn.com purchases

Our refund policy

Refunds go back to the original payment method within 5–10 working days of us approving them. Ask at support@famzolearn.com.

7.7 Taxes

Prices shown on famzolearn.com include Indian GST where it applies. For purchases through Apple or Google, tax is shown by the store before you confirm. Prices are set per country in local currency, not converted from a dollar price.

7.8 Failed payments

If a renewal payment fails we will retry it and email you. If it still fails, the subscription lapses and access to new daily content stops. Your progress is not deleted — it is waiting if you come back.

8Your licence to the content

While your subscription or trial is active, we give you a personal, non-exclusive, non-transferable, revocable licence to use Famzo Learn and its content for your own family’s private, non-commercial use, on the devices you and your household normally use.

You are welcome to read a story aloud to your own child, to a visiting cousin, or at a family gathering. You are not licensed to use the content in a school, nursery, daycare, tuition centre, library, clinic or any other institutional or commercial setting. If you want to do that, write to us — we would rather talk about it than find out later.

9What you may not do

If you find a security weakness, please tell us at support@famzolearn.com before telling anyone else. We will not pursue anyone who reports one in good faith and gives us a reasonable chance to fix it.

10The Friends circle

The Friends circle lets two families link their children’s streaks. It works by invite code because there is deliberately no way to search for a child inside the app.

11What this app is not

Please read this section

Famzo Learn is a supplement to the ordinary business of raising and teaching a child. It is not:

We check facts carefully and correct errors when they are reported, but we do not warrant that every fact, translation, pronunciation or retelling is free of error. Story retellings are simplified for young children and are not scholarly or religiously authoritative texts. Tell us at support@famzolearn.com if you spot something wrong and we will look at it.

12Availability and changes

We try to keep Famzo Learn working, but we do not promise it will be available without interruption. Maintenance, an outage at Google (whose Firebase infrastructure we run on), an app-store problem, or your own connection can all stop it working for a while. Most of the app keeps working offline once a day’s content has loaded.

We may change, add or remove features. If a change materially reduces what a paid subscription gives you, we will tell you before it takes effect and you may cancel and ask for a refund of the unused part of the period.

If we ever discontinue Famzo Learn entirely, we will give at least 90 days’ notice by email, stop taking new payments immediately, refund the unused part of any subscription period already paid for. We will also tell you how to export or delete your data before it goes.

13Ending the agreement

You may stop at any time: cancel the subscription as in section 7, delete the app, and—if you want the cloud record gone—email privacy@famzolearn.com from the account address. We delete everything within 30 days and confirm.

We may suspend or close an account if it is being used in breach of section 9, if a payment is fraudulent or charged back, or if we are required to by law. Where it is safe and lawful to do so we will tell you first and give you a chance to put it right. If we close a paid account for a reason that is not your breach, we refund the unused part of the period.

Sections 8, 9, 15, 16, 18 and 21 survive the end of this agreement.

14Privacy

How we handle data is set out in the privacy policy, which forms part of these terms. In summary: no advertising, no analytics, no third-party tracking; your child’s nickname and age never leave the device; and what we hold in the cloud is a parent’s email address and learning progress against a random account number.

15Our intellectual property

The Famzo Learn name, logo, the app, the web app, this website, the story retellings, the card text, the language material, the quiz questions and the arrangement of all of it belong to us or to our licensors and are protected by copyright and trade mark law. Nothing in these terms transfers any of it to you.

The photographs are freely licensed images — largely from Wikimedia Commons and public-domain sources — that we have checked, credited and hosted ourselves. Their own licences continue to apply to them, and credits are shown in the app. Traditional tales such as the Ramayana and the Panchatantra are ancient and belong to everyone; our particular retelling, wording and illustration of them is ours.

If you think something in Famzo Learn infringes your rights, write to [GRIEVANCE OFFICER EMAIL] with enough detail to identify the work and where it appears, and we will respond within 15 days.

16Warranties and liability

Nothing in this section limits any right you have under the Consumer Protection Act, 2019 or any other law that cannot be excluded by agreement. In particular, your statutory rights as a consumer in India — and the equivalent rights where you live — are unaffected by anything below.

Subject to that: Famzo Learn is provided “as is”. To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not warrant that the service will be uninterrupted, error-free, or that the content is complete or accurate.

To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, loss of data, or any loss arising from your child’s use of the app without adult supervision. Our total liability to you for any claim connected with Famzo Learn is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose, and (b) [INR 2,000].

We are not liable for anything Apple, Google or your payment provider does or fails to do with a purchase made through them.

17Changes to these terms

We may update these terms. The date at the top changes when we do, and the previous version stays available on request. For a change that materially affects your rights or what you pay, we will give at least 30 days’ notice by email and in the app before it takes effect. Continuing to use Famzo Learn after that date means you accept the new terms; if you do not, cancel and tell us, and we will refund the unused part of your period.

18Governing law and disputes

This agreement is governed by the laws of India. Subject to the paragraph below, the courts at [CITY], India shall have exclusive jurisdiction.

Please write to us first — support@famzolearn.com — before starting anything formal. Most things are a misunderstanding and we would rather fix it than argue about it. If you are a consumer, nothing here stops you bringing a complaint before the consumer forum for the place where you live, or, if you live outside India, in the courts of your own country where the law gives you that right.

20Apple App Store terms

This section applies only to the version downloaded from the Apple App Store, and Apple requires it to be here.

  1. This agreement is between you and us alone, not with Apple. Apple is not responsible for the app or its content.
  2. Your licence to use the app is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
  3. Apple has no obligation to provide maintenance or support for the app. Support requests go to support@famzolearn.com.
  4. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
  5. We, not Apple, are responsible for any claim relating to the app — product liability, a failure to conform to a legal requirement, or a consumer-protection claim.
  6. We, not Apple, are responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights.
  7. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government prohibited-party list.
  8. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
